Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Clearspace (“Clearspace,” “we,” “us,” or “our”) governing your access to and use of our applications, websites, membership program, and related services (collectively, the “Services”). By applying for membership, creating an account, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
Our Privacy Policy describes how we collect, use, and share information, and is incorporated into these Terms by reference.
1. The Services
Clearspace is a screen-time membership for families. Membership includes access to our applications and device-management tools and a personal Clearspace concierge line — a dedicated phone number you can text to set up the app, connect your children’s devices, create and adjust screen-time rules and schedules, approve or deny requests for more screen time, and get ongoing guidance for your family’s digital wellness.
2. Membership Applications and Accounts
- You must be at least 18 years old (or the age of majority in your jurisdiction) to apply for and hold a Clearspace membership.
- Membership begins with an application on our website. As part of applying, you verify your phone number with a one-time code. We review applications individually and may accept or decline any application at our discretion.
- The Services are intended to be set up and managed by adults. A parent or legal guardian may configure the Services for use by children in their family, and is responsible for that use and for providing any consent required by law.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at support@clearspace.org if you suspect unauthorized use of your account.
- You agree to provide accurate, current, and complete information when applying and maintaining your account.
3. SMS / Text Messaging Terms
If you opt in to receive text messages from Clearspace, the following terms apply.
- Program Description. Clearspace sends account and service-related text messages: phone verification codes, application and membership updates, and — once you are a member — two-way conversations with your Clearspace concierge on your dedicated concierge line. The concierge guides you through app setup and helps you manage your family’s screen-time rules, schedules, and requests, and can send you activity updates you have asked for.
- Consent. By providing your phone number and checking the opt-in box in our application, you expressly consent to receive text messages from Clearspace at that number. Consent to receive text messages is not a condition of any purchase. Your consent applies only to messages from Clearspace.
- Message Frequency. Message frequency varies based on your account activity and preferences — the concierge primarily replies to messages you send, plus notifications you have enabled.
- Message and Data Rates. Message and data rates may apply. Please contact your wireless carrier for details about your messaging plan.
- Opt-Out. You can opt out at any time by replying STOP to any message. After you send STOP, we will send one final message confirming that you have been unsubscribed, and you will no longer receive text messages from us. To re-enroll, sign up again through the Services or contact us.
- Help. For assistance, reply HELP to any message or contact us at support@clearspace.org.
- No Sharing of Mobile Information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with, sold to, or purchased by any third parties.
- Carriers. Wireless carriers are not liable for delayed or undelivered messages.
- Privacy. Our collection and use of your phone number and messaging information is described in our Privacy Policy.
4. Membership and Billing
- Clearspace membership is a paid subscription. Pricing and plan details are presented at checkout before you purchase.
- Memberships are billed by our payment processor, Stripe. Clearspace does not store your full card details.
- Unless otherwise stated, memberships renew automatically at the end of each billing period until canceled. You may cancel at any time through your membership portal on our website, by asking your concierge, or by emailing support@clearspace.org; cancellation takes effect at the end of the current billing period.
- Except where required by law or expressly stated otherwise, payments are non-refundable.
5. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation;
- Access or attempt to access another user’s account or data without authorization;
- Interfere with, disrupt, or attempt to probe, scan, or test the vulnerability of the Services or related systems;
- Reverse engineer, decompile, or disassemble any part of the Services, except to the extent permitted by law;
- Resell, sublicense, or use the Services on behalf of third parties without our prior written consent; or
- Use the Services to send spam or unsolicited communications.
6. Intellectual Property
The Services, including all software, content, designs, logos, and trademarks, are owned by Clearspace or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use. No other rights are granted.
7. Mobile Applications and App Store Terms
Membership includes access to our mobile applications, which you download from the Apple App Store or other app marketplaces. Your download and use of those applications may also be subject to the marketplace’s own terms, including any applicable end user license agreement. Those marketplace terms govern your license to the application software; these Terms govern your membership and use of the Services, and membership billing is handled by Clearspace through Stripe, not through the app marketplace.
8. Termination
- You may cancel your membership and stop using the Services at any time.
- We may decline an application, or suspend or terminate your access to the Services, if you violate these Terms, if required by law, or if we discontinue the Services. Where practical, we will provide reasonable notice.
- Upon termination, your right to use the Services ends. Sections that by their nature should survive termination (including Sections 6, 9, 10, and 11) will survive.
9. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.
The Clearspace concierge may use automated and AI-powered systems to respond to your messages. Concierge guidance is provided for convenience and general informational purposes; it may occasionally be incomplete or inaccurate, and it is not medical, psychological, legal, or other professional advice. Clearspace is a tool to support digital wellbeing; parents and guardians remain responsible for supervising their children’s device use.
10. Limitation of Liability
To the maximum extent permitted by law, Clearspace and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Services. To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the Services will not exceed the greater of the amount you paid us for the Services in the twelve (12) months before the claim arose or one hundred U.S. dollars ($100).
11. Indemnification
You agree to indemnify and hold harmless Clearspace from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or your misuse of the Services.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction, except where applicable law requires otherwise.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by updating the effective date above and, where appropriate, through the Services. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
